Abstract

This article argues for the geographical decentralization of the Supreme Court of India. Baxi posits that the concentration of the apex court in Delhi creates a physical and financial barrier for litigants from distant states, violating the spirit of Article 21. He clarifies that Article 130 of the Constitution already empowers the Chief Justice, with Presidential approval, to appoint other seats. By establishing regional benches for appellate matters while keeping a Constitutional Bench in Delhi, the judiciary can move from "Supreme Court of Delhi" to a true "Supreme Court of India," ensuring justice is inclusive and accessible to all.
