Abstract
Focusing on the interpretation of Section 306 of the IPC, this article discusses the judicial shift toward a more nuanced understanding of "instigation." Baxi examines cases where the Supreme Court has warned against the mechanical application of abetment laws, particularly in professional or marital stress situations. He argues that "relief" comes from the court’s insistence on a clear mens rea (guilty mind) and a direct link between the accused’s act and the victim's choice.
