Abstract
Baxi critiques the historic neglect and dehumanization of persons with mental illness in the legal system. He examines the shift from "charity" to a "rights-based approach" under the Mental Healthcare Act, 2017. The article argues that "mental health" is an integral part of the "right to life" under Article 21. Baxi highlights the role of the judiciary in closing "custodial" asylums and promoting community-based care.
