Abstract
Baxi revisits the proposal to bifurcate the Supreme Court into a "Constitutional Court" and a "National Court of Appeal." He argues that the current "overburdened" court cannot devote sufficient time to complex constitutional issues. The synopsis notes Baxi’s support for this structural change to reduce the "judicial backlog" and restore the apex court’s role as the "guardian of the Constitution." He suggests that a specialized Constitutional Court would lead to a more coherent and well-reasoned jurisprudence, while the Court of Appeal would provide the finality and "geographic accessibility" required for routine appellate matters.
