Abstract
Building on his earlier theme, Baxi frames the migrant exodus as a "performative act of civil disobedience." He argues that by walking thousands of miles, the workers "voted with their feet" against a state that failed to recognize their "right to exist." The article posits that this was a "constitutional moment" where the "invisible people" became "visible." Baxi critiques the judiciary’s initial silence and subsequent "delayed response." He asserts that the exodus was a "judgment" on the failures of neoliberal constitutionalism, demanding a shift toward a more "rights-based" and "labour-centric" legal order that respects the "dignity of the feet."
