Upendra Baxi's article, "Non-Criminal Lunatics in Prisons – Twilight of Human Rights in India", critiques the Indian legal and administrative system for its inhumane treatment of individuals with mental illness who are incarcerated in prisons despite not having committed any crime. A powerful critique of the 2002 Gujarat violence, Baxi analyzes what he terms "holocaustian politics"—state-orchestrated communal violence that systematically subordinates minorities, establishes collective guilt, and transforms governance into a mechanism for majoritarian dominance and minority persecution through organized pogrom.
